Specimen Warranty

 

Terms and conditions of the Fairfax Cryobank (“Cryobank”) specimen warranty:

a. Specimen Quality Specifications are as follows:

IUI & ICI: minimum of 35% motility and minimum total motile cells (TMC) of 20 million/ml (10 million/vial)

IVF: minimum of 35% motility and 5 million TMC/vial.

b. Our specimen quality standards for motility (%) and total motile cells (TMC) are approximations due to variations in analytical methods and personnel among laboratories.  There will always be differences in counting and analysis among technicians because semen is not a homogeneous mixture.     It is possible for a laboratory or a physician’s office to do an analysis that indicates a particular sample is below our warranted quality standards.  However, this does not necessarily mean that the specimen is not suitable for insemination or that a pregnancy will not result if used for insemination.   The Cryobank will take into consideration these variations between labs in determining if a specimen is eligible for a full or partial credit. 

 

c. The physician/clinic must follow the Cryobank’s printed thaw procedures enclosed in each shipment.   Be aware that thaw procedures may vary among specimens.  Failure to follow our thaw instructions will void this warranty.

 

d. Our specimen warranty applies at the time of thaw and prior to any post thaw processing.  

 

e. Specimens stored outside Fairfax Cryobank longer than 60 days are not eligible for credits. We do not have control over the storage and handling practices of outside laboratories or at other storage facilities. 

 

f. Our shipping tanks will keep specimens frozen for 7 days.  Physicians or laboratory personnel who receive our tanks containing specimens should check the tank upon arrival to be sure that the specimens arrive frozen.  If you suspect that specimens have thawed, please call 1-800-338-8407 immediately and speak with a laboratory technician.   If the specimen arrives thawed, we will ship via FedEx Priority Overnight Service replacement specimens at no charge.  If replacement specimens are shipped and not used, they can only be returned to the Cryobank for storage and are not eligible for any credit. Shipping tanks are available that will keep the specimens frozen for 14 days for an additional charge.  Contact customer service for details.  

 

g. If a specimen tests below our standards, the physician/clinic must report specific specimen data and submit a complaint within 5 business days of thawing.  Notification is to be made using the Fairfax Cryobank complaint form. Call 1-800-338-8407 to have a complaint form faxed to your physician’s office.

 

h. Shipping costs cannot be refunded unless specimens arrive thawed or otherwise compromised by the shipping process.

 

i. No credit will be made if a pregnancy is achieved with a specimen.

 

j. The Cryobank’s liability for any deficiency in specimen quality will be limited to supplying a replacement specimen or cash refund, at the Cryobank’s discretion.  The cryobank will in no event be liable for any consequential or incidental damages, including but not limited to any additional expenses incurred by the patient during infertility treatment.

k. Warranty is void if ownership of specimens is transferred to a different owner prior ro use.
